Terms & Conditions

Last updated: 21 October 2026

1. Who we are

We are De Spruce Ventures Ltd (company number 17334719), trading as Despruce, a company registered in England and Wales, with our registered office and place of business at Unit A, De Spruce Ventures Ltd, 82 James Carter Road, Mildenhall, Suffolk, IP28 7DE, United Kingdom. You can contact us at [email protected] or by post at the address above.

References in these terms to “we”, “us” or “our” mean Despruce Fashion. References to “you” mean the person placing an order on this website.

2. These terms

These terms and conditions (“Terms”) govern all orders placed on www.desprucefashion.com and, together with our Privacy Policy and Returns & Refunds policy, form the agreement between us.

Your contract with us is a contract between you and us only. No other person has any rights under these Terms.

We may update these Terms from time to time. The Terms that apply to your order are the ones in force on the date you place it. Every time you order from us, the Terms in force at that time will apply.

3. Placing an order and how the contract forms

  • Adding an item to your basket does not reserve it. It remains available for others to buy until your order is placed and accepted.
  • When you place an order, you make an offer to buy the item(s). We may decline or cancel any order at our discretion, including for suspected fraud, stock unavailability, or errors in pricing or product information. If we cancel after payment, you receive a full refund.
  • The contract between us forms at the moment we send your order confirmation email. If you do not receive one, check your spam folder, then contact us.
  • Please check the confirmation email carefully and tell us promptly if anything is wrong. If the information is incorrect, contact us within 24 hours so we can correct it before dispatch.

4. Products

  • The images of products on our site are for illustration. While we photograph our products carefully, colours may vary slightly depending on your screen, device and lighting. We cannot guarantee that your device displays colours accurately.
  • Products may vary slightly from their images, and packaging may vary from that shown.
  • All products are subject to availability. If an item becomes unavailable after you order, we will tell you as soon as possible and refund you in full.
  • Jewellery is made from the materials stated in the product description (for example, 18k gold plated brass). Please read product descriptions, including care instructions, before ordering.

5. Prices and payment

  • All prices are in pounds sterling (GBP) and include VAT where applicable.
  • Delivery charges are as described on our Shipping page and are confirmed at checkout before you pay.
  • It is always possible that, despite our best efforts, some products may be incorrectly priced. We will normally check prices before accepting your order. Where a genuine pricing error is obvious and unmistakable and could reasonably have been recognised by you as a mispricing, we may cancel the order and refund any payment you have made.
  • Payment is taken securely through Stripe. We accept all major debit and credit cards. Your card details are processed by Stripe and are never stored on our systems.
  • We may carry out fraud and identity checks (for example, verifying your delivery address) before dispatch. These are done to protect you and us.

6. Delivery

  • We deliver to addresses in the UK and to the international destinations offered at checkout. Delivery costs and estimated delivery times are shown at checkout and on our Shipping page.
  • For deliveries outside the UK, you are the importer. Any import VAT, customs duty and courier handling fees charged by the destination country are payable by you on delivery and are not included in our prices.
  • Orders are normally dispatched within 1–2 working days of the contract forming. Delivery estimates are not guaranteed, but we will take reasonable steps to deliver on time or tell you of any delay.
  • Next-day delivery: next-day delivery is an estimated service and not guaranteed. Orders are handled by a third-party courier, and delivery times may be affected by circumstances outside our control. While we dispatch orders promptly, we cannot guarantee delivery on a specific date.
  • The risk in the goods passes to you on delivery to the address you provided. Until then, goods lost or damaged in transit are our responsibility.
  • You must provide an accurate delivery address and ensure someone is available to receive the parcel or use any leave-safe option you choose. We are not liable for delayed or missing deliveries where the delay or loss was caused by an incorrect or incomplete address you supplied.
  • If delivery fails after the carrier has attempted delivery and used reasonable means to contact you (including a calling card or collection notice), the parcel may be returned to us. We will contact you to arrange redelivery, including any charge before you agree to it, or a refund where one is due under applicable law.
  • Ownership (title) in the goods passes to you when we receive full payment for the order.

7. Your right to cancel (14 days)

If you are a consumer, you have a legal right to cancel a distance contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The following explains that right. This is a cancellation right — it does not cover items that are faulty or not as described (see section 8).

  • You have 14 days from the day after the day you (or someone you nominate) receive the goods to cancel, for any reason.
  • To cancel, email [email protected] with your order number. You may use the model form below or send any other clear statement. You may cancel before delivery or during the 14-day period.
  • After you cancel, you must return the goods to us within 14 days of telling us. We will provide the return address. Return costs are yours, unless the goods are faulty or not as described.
  • You may handle the goods to check their nature, characteristics and functioning as you would in a shop. If you handle them beyond that and this reduces their value, we may deduct an amount for that loss in value from your refund, up to the full price.
  • We refund you no later than 14 days after receiving the goods back or evidence that you sent them, whichever happens first. We refund by the original payment method and may withhold the refund until then.
  • Where you cancel the whole order, we refund standard delivery charges paid, but not premium or express charges.
  • Hygiene exception: the cancellation right does not apply to pierced earrings and other body jewellery once the sealed hygiene packaging has been unsealed, unless the item is faulty or not as described. This reflects the exemptions in the 2013 Regulations for sealed goods unsuitable for return for health protection and hygiene reasons.

8. Faulty, damaged or incorrect items

As a consumer, the Consumer Rights Act 2015 gives you legal rights: goods must be as described, fit for purpose and of satisfactory quality.

  • During the first 30 days after delivery, if an item is faulty you may reject it for a full refund (or ask for a repair or replacement).
  • For faults appearing within 6 months of delivery, we accept the fault was present at delivery unless we can prove otherwise.
  • After 6 months, you may still have remedies; contact us and we will assess the fault and explain your options.
  • If an item is faulty, not as described or the wrong item was sent, we refund in full — including any delivery costs you paid — and we arrange and pay for return postage.
  • Digital Markets, Competition and Consumers Act 2024 protections against unfair trading also apply to your purchase. Nothing in these Terms affects any of your statutory rights.

9. Your account

  • You must provide accurate, current and complete information when creating an account and keep it updated.
  • You are responsible for keeping your password confidential and for activity on your account. Tell us immediately if you suspect unauthorised use.
  • We may suspend or close your account, and refuse orders, if we reasonably suspect fraud, abuse of promotions, unlawful activity, or a serious breach of these Terms. Where we do, we will refund any payment for goods we have not delivered.

10. Promotions and discount codes

Promotional codes and offers are subject to any specific conditions stated with them. We may withdraw or amend promotions at any time. Codes cannot be exchanged for cash, are usually single-use, and may be withdrawn if resold or used in a way we reasonably consider abusive. Promotions do not apply to orders already placed.

11. Intellectual property

The content of this website — including text, photography, logos, product designs and the Despruce name — is protected by copyright, trade mark and other intellectual property rights, owned by or licensed to us. You may not copy, reproduce or use any of it for commercial purposes without our written permission.

12. Liability

Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; defective products under the Consumer Protection Act 1987; or any other liability that cannot lawfully be limited.

Subject to that, our total liability to you for any claim connected with an order or these Terms is limited to the greater of the price you paid for the goods or £500. We are not liable for business losses (these Terms apply to consumers only), for losses not reasonably foreseeable at the time of your order, or for loss caused by events beyond our reasonable control (see section 13).

13. Events beyond our reasonable control

We are not liable for delays or failure to perform where caused by events beyond our reasonable control, including strikes, extreme weather, public health measures, utility or internet failures, or carrier disruptions. If such an event continues for more than 30 days, you may cancel any affected undelivered order for a full refund.

14. Complaints

If something has gone wrong, contact us first at [email protected] — we aim to resolve complaints within 5 working days. You may also contact your local trading standards service or bring proceedings in the courts described in section 16.

15. Other important terms

  • If a court finds any part of these Terms unenforceable, the rest continues to apply. The unenforceable part is replaced with an enforceable version as close as possible to the original intention.
  • If we do not insist immediately that you do something you are required to do, that is not a waiver of our rights.
  • We may transfer our rights and obligations under these Terms to another organisation (for example, in a business sale). We will tell you in writing if this happens. You may only transfer your rights to another person where we agree in writing.
  • These Terms are the entire agreement between us in relation to your orders. They replace any previous terms.
  • Links to third-party websites are provided for convenience; we are not responsible for their content or policies.

16. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. If you are a consumer, you may bring proceedings in the courts of England and Wales, or (if you live in Scotland or Northern Ireland) in the courts of your home country. If you are acting as a business, the courts of England and Wales have exclusive jurisdiction.
